Factors for Choosing a Franchise Attorney:

As experienced as a person might be in his or her own business, he or she does not have the experience necessary to directly assess the qualities of a franchise attorney any more than a surgeon for an operation.  It helps, therefore, to focus on the attorney's credentials, which are objective measures of the attorney's capability, performance and professional standing.

One important credential is the number of years an attorney or law firm has focused primarily on franchise law and related issues.  I recommend 10 years of such experience as the minimum acceptable level.

Another important credential is being part of the American Bar Association Forum on Franchising.  Almost all franchise attorneys in private practice are members of this organization, which exists to keep its members up to date on current franchise developments.  I suggest 10 years membership as the minimum acceptable level.

Another useful credential is the peer review ratings by other lawyers for Martindale Hubbel.  An AV rating is the highest and I suggest choosing only an AV rated attorney. 

Martindale Hubbel compiles a list of the highest rated 5% of the attorneys in the USA for its Bar Register of Preeminent Lawyers.  Inclusion here is a positive credential.
